5. EB-2 NIW Educational Offerings
EB-2 National Interest Waiver courses, consultations, digital resources, and mentorship programs are provided solely for educational and informational purposes.
Earth Review is not a law firm. Earth Review and its mentors do not act as immigration attorneys or legal representatives.
EB-2 NIW offerings do not include:
- Legal advice or legal opinions
- Immigration eligibility determinations
- Individualized legal strategy
- Preparation or completion of immigration forms
- Preparation of legal filings
- Legal review of a petition
- Representation before USCIS
- Communication with USCIS on behalf of a participant
- An attorney-client relationship
- A guarantee of approval or any immigration result
Educational discussions concerning professional profile development, publicly available USCIS information, document organization, recommendation letter planning, evidence management, or petition workflow do not constitute legal advice.
Participants remain responsible for preparing, reviewing, signing, and submitting their own materials or obtaining assistance from a licensed U.S. immigration attorney or another properly authorized immigration legal-service provider.
6. User Accounts
Certain products and services require an account.
You are responsible for:
- Providing accurate registration information
- Maintaining the confidentiality of your username and password
- Protecting access to your registered email account
- All activity conducted through your account
- Notifying Earth Review promptly about suspected unauthorized use
Accounts and course access are personal and may not be shared, transferred, sold, or assigned without written permission.
We may suspend or terminate an account that violates these Terms, misuses our materials, creates a security risk, or is associated with fraudulent activity.
7. Prices and Promotional Offers
Prices are displayed in U.S. dollars unless otherwise stated.
A crossed-out, regular, introductory, promotional, or sale price applies only as described on the applicable product page. Promotional offers may be limited by date, enrollment capacity, availability, or another clearly disclosed condition.
The price confirmed for your purchase is the amount displayed and accepted at checkout, excluding any separately disclosed taxes, optional additions, currency-conversion charges, or third-party financial-institution fees.
Changes to prices apply to future purchases and do not change the confirmed price of an order already completed.
Promotional codes and discounts:

When Earth Review cancels a paid order before delivering the product or service, any amount owed to the customer will be handled according to the Refund Policy and applicable law.
9. Refunds and Cancellations
All purchases are subject to our Refund Policy and any additional cancellation terms displayed on the applicable product, service, booking, or checkout page.
Refund eligibility depends on factors that may include:

- Whether digital content was accessed or downloaded
- Whether a course was substantially accessed
- Whether a consultation was completed or missed
- Whether a mentorship stage began
- Whether personalized work was commenced or delivered
- Whether a customized project milestone began

Digital products and substantially accessed educational materials are generally nonrefundable except as stated in the Refund Policy or required by law.

10. Digital Products and Course Access
Purchasing a digital product or course grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the materials for your own educational or internal business purposes.
Purchasing access does not transfer ownership of the materials or underlying intellectual property.

11. Consultations and Appointments
Consultations provide educational or professional guidance within the scope described on the booking page.
Customers are responsible for:
- Attending on time
- Providing accurate information
- Preparing any requested materials
- Maintaining a functioning internet connection and device
- Rescheduling within the required notice period
The applicable booking page or Refund Policy will state the cancellation and rescheduling deadline.
Late cancellations, missed appointments, and late arrivals may result in the session being counted as used.
A consultation that has been completed is generally nonrefundable except where required by law or where Earth Review materially failed to provide the purchased service.
12. Mentorship Programs
Mentorship programs may include private sessions, educational resources, email support, progress tracking, accountability assistance, and other benefits described on the applicable program page.
Participants are responsible for:
- Scheduling sessions within the program period
- Completing agreed educational action items
- Providing requested professional information
- Reviewing program materials
- Responding to scheduling communications
- Making reasonable use of available support
Unless Earth Review approves an extension in writing:
- The mentorship period begins on the confirmed start date
- Sessions must be used within the stated program period
- Unused sessions expire at the end of the program
- Participant-caused delays do not automatically pause or extend the program
- Unused sessions do not have a separate cash value
Refunds and cancellations for mentorship programs are governed by the applicable product terms and Refund Policy.
13. Business-to-Business and Customized Services
Earth Review may provide customized services to businesses, organizations, researchers, professionals, and other clients.
These services may include:
- Website design and development
- Website maintenance
- Search engine optimization
- Digital marketing
- Social media services
- Promotional media

- CV development
- Research communication
- Other customized professional services
The applicable proposal, statement of work, quotation, invoice, or service agreement may define:

14. Client Responsibilities for Customized Services

Project timelines may be extended when the client:

Earth Review is not responsible for delays caused by incomplete client materials, third-party services, hosting providers, platforms, payment processors, or circumstances outside our reasonable control.
15. Revisions and Approval
The number and scope of revisions for customized services will be stated in the applicable service description or agreement.
A revision generally means a reasonable modification to an existing deliverable. A request that changes the original scope, direction, functionality, structure, or content may be treated as additional work.
A deliverable may be considered accepted when:
- The client provides written approval
- The client publishes or begins using it
- The client does not provide requested feedback within a reasonable period stated in the agreement
Additional work may require additional payment.
16. Intellectual Property
Unless otherwise stated, website content and educational materials are owned by Earth Review, Nayem Digital LLC, or their licensors.
Protected materials may include:
- Articles
- Videos
- Courses
- Graphics
- Logos
- Images
- Templates
- Workbooks
- Checklists
- Course slides
- Downloadable resources
- Website designs
- Software configurations
- Written frameworks
- Business materials
For customized client projects, ownership and licensing will be governed by the applicable written agreement.
Unless the agreement states otherwise:
- Earth Review retains ownership of preexisting methods, templates, systems, tools, code, frameworks, and general knowledge
- The client retains ownership of materials supplied by the client
- Ownership of final custom deliverables transfers only after full payment when transfer is included in the agreed scope
- Third-party themes, plugins, fonts, stock assets, software, and platform components remain subject to their respective licenses
- Earth Review may retain internal archival copies as reasonably necessary for business and legal records
17. Client-Provided Materials
By providing content, images, trademarks, data, credentials, or other materials, you represent that:
- You own the materials or have permission to use them
- Their use will not violate another person’s rights
- They are accurate and lawful
- They do not contain malware or prohibited content
You grant Earth Review a limited license to use the materials as necessary to provide the purchased service.
You remain responsible for obtaining permissions, licenses, releases, and approvals for materials you provide.
18. Academic Integrity and Research Services
Earth Review may provide educational guidance relating to:

Users remain responsible for:

We do not guarantee:
- Immigration eligibility or approval
- Avoidance of an RFE or other government notice
- Admission or scholarships
- Research publication or citations
- Employment or career advancement
- Business revenue, leads, or sales
- Search-engine ranking
- Social media growth
- Funding or grants
- Website traffic
- Any specific educational, professional, academic, or commercial outcome
Any examples, testimonials, past results, or personal experiences are illustrative and do not promise that another customer will obtain the same result.
24. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website, educational content, digital products, and services are provided on an “as is” and “as available” basis.
Except for any express service commitment stated in writing and any warranty that cannot legally be excluded, Earth Review disclaims implied warranties concerning merchantability, fitness for a particular purpose, noninfringement, uninterrupted availability, and error-free operation.
Nothing in these Terms limits a right or warranty that cannot legally be waived.
25. Limitation of Liability

Termination does not eliminate payment obligations for services already performed, completed milestones, accessed digital products, or other amounts properly due.

Before filing a formal claim, the parties are encouraged to attempt in good faith to resolve the matter through written communication.
32. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
The invalid provision will be interpreted or limited only to the extent necessary to make it enforceable where legally possible.
33. No Waiver
Earth Review’s failure to enforce a provision on one occasion does not waive the right to enforce it later.
A waiver is effective only when confirmed in writing by an authorized representative of Earth Review.
34. Assignment
You may not transfer your account, enrollment, service agreement, or rights under these Terms without Earth Review’s written permission.
Earth Review may assign its rights and obligations as part of a merger, restructuring, sale, or transfer of the relevant business, subject to applicable law.
35. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, applicable product description, and any proposal, quotation, statement of work, invoice, or written service agreement, constitute the agreement between the parties concerning the applicable transaction.
They replace prior discussions or representations concerning that transaction, except for terms expressly preserved in a signed written agreement.
